Trademark Registration in Nepal is conducted by submitting an Application to the Department of Industry and takes 12-14 Months to be completely Processed. 5. Is there any ground of refusal of trademark registration?

Under section 18(1) of PDTA, the DOI has power to reject the application of trademark registration on the following grounds:

  1. If such trademark damages the reputation of any person or institution, or
  2. If such trademark contradicts with public conduct/morale or national interest, or
  3. In case such trademark damages goodwill of trademark of any person, or
  4. In case such trade-mark is found to have already been registered in the name of another person.
